Violation: One-page site (lead) was engaged in selling counterfeit shoes. The violator and hosting didn’t respond to claims for stopping the violations. Website received the traffic from teaser advertising networks without any possibility to cut it.

Solution: In a short time, we developed a program which has been sending 24/7 orders to the violator’s website, changing the IP addresses, names, surnames, phone numbers and delivery addresses, generating more than 5,000 orders per day. It was impossible for the violator to distinguish the real orders from the generated ones. As a result, the shop was closed and the violations were stopped.

We would like to highlight case with sunglasses.  One of the most popular and competitive product niche with a large amount of counterfeits. If you look «sunglasses» up online and you will be taken to all kinds of web sites approximately up to 65 million. Good money attracts a huge number of pirates!

Leading position is taken by authorized dealer «Luxoptika» which offers original products.

The second position is taken by the Prom.ua marketplace where counterfeit products are sold. The sellers’ contacts information contains only mobile phones, the seller’s name and the city’s name. Buyers don’t have the opportunities to contact the seller in a case of claim for refund or good’s replacement.

The third position is given to the site glasses.ua. It receives high search traffic accordingly provides good revenue to the owner. On glasses.ua you can buy Ray Ban glasses at the average price 495 UAH  and at «Luxoptika»  the same brand glasses costs 2300 UAH. Emporio Armani glasses will cost approximately 1490 UAH and  «Luxoptika»  sells the same glasses brand for 3000 UAH already with 50% discount.

The largest Ukrainian marketplace Rozetka is holding forth position. Here you can buy Ray Ban glasses for 600 UAH. The seller’s name is VERmarket and we have doubts about if the product is original or not.

In the fifth place is o4ki.kiev.ua site.  It showroom has the same address as the glasses.ua store.  Here Ray Ban glasses price varies from 495 to 795 UAH. According to this we can make conclusion the both websites belong to the same owner who sells non-original products. Websites provide with this information but it doesn’t say in product card what can easily confuse the buyers. Trading with counterfeit product is a crime.

Showroom-kiev.com.ua is in the sixth place. It sells Ray Ban glasses at the average price of 500-900 UAH. Shop’s email address registered on the ukr.net service and the company’s location address shows only street name. We can admit for sure this shop sells replicas.

The seventh position is held by shop o4ki.kiev.ua also.

The eighth place in our rating belongs to bulletin board olx.ua. Here we can find plenty of fakes.

These web sites get 90% of all traffic and only the one sells the original product! So, please, make conclusions how much income or money famous brands lose due to high-quality fakes or replicas scattered on the UA market which are always mostly confused with original products.   

The glasses.ua internet shop even informs the customers that it sells «quality copies and replicas». If this net of selling counterfeits, fakes or replicas will be destroyed it will increase the profit of official seller by 25-100%.

The well-known electronics brand requested to us to clean the market up in a one month.   Premium tariff plan was chosen and contract was signed. The process has been launched.

The first stage:  Our client provided us with a list of authorized sellers. We collected the data which resulted in 46 online shops and more than 2,000 ads on bulletin boards.

The second stage: All violators were sent a message to remove the illegal goods.  10% – removed goods, 30% – were prepared to engage in dialogue, 60% – ignored the message.

The third stage: We sent claims on hosting and one claim to domain name registrar. In this way  80% of violations were remedied.

The fourth stage: Claims were sent to search engines. After that URL addresses of violators were removed from the search database and traffic was stopped. Further to the our claim repeated request the violators removed 100% of the goods.

The fifth stage: The claim was brought to trial. The subject-matter of claim is domain name which includes the trademark of our client. Case was won in the first instance and domain name was returned to the client.

Our business cooperation continues successfully. We support the «purity» of the market and have been actively monitoring and removing violations.

Within 30 days the customer’s product was removed from 44 stores and all commercials. 2 more shops are in procedure.

This market segment suffers from the dominance of counterfeit products which destroys it and undermines the viability of the legal products. Authorized sellers bear losses as a result of illegal sales.  

Some sellers truly say that they sell replica, some hide this fact and some say they sell the original products. Counterfeit distribution channels are standard : online stores, marketplaces, social networks, messengers, bulletin boards, price aggregators.

We don’t need to look for official sellers because we have been given the list of them. And we can start our performance.

The client chose the “Individual” tariff plan and our team start the project. And what we have  achieved or done?

1) During the first month we almost completely removed the customer’s products from marketplaces and price aggregators, around 5,000 ads from the boards, 9,000 offers on the social network facebook.  389 Instagram accounts and 19 groups in viber were blocked.

2) After the selection of authorized stores, 215 claims were sent with the demands to remove 17,500 URL addresses which sell counterfeit brand goods. 114 claims were sent to hosting, 29 claims were sent to processing centers, and 4 claims were brought to trial for unauthorized use of the domain with the name of customer’s trade brand.

3) The procedure for determining the Trademark as well-known has started. This status increases the opportunities for brand protection and gives a number of advantages to the owner.

4) After three months of work sales of authorized stores have grown by 30%.  It has been a group effort.

5) We continue our fruitful cooperation with the brand company. Two employees are engaged in this area of work. The client is provided with weekly and monthly reports on the work performed, detailed information on the number of removed URL addresses, the current situation on work with violators.

We were approached by a well-known brand of clothing and accessories with the task to clean the market as much as possible in six months and to maintain its «purity».

Due to the brand’s popularity on the market numerous offers of illegal sales were taken place     through online stores, marketplaces, social networks, messengers, bulletin boards. This situation kept official merchant from making a profit. They looked forward to a substantial outcome of our work.

1) Simultaneously with the authorization of online stores we began sending claims to sales channels which definitely couldn’t sell the original product.

Surely, we made things unpleasant for some people who like to become «free riders». We were    threatened in aggressive way even received physical threats.
